DraftKings Predictions is now available in California, giving the company access to one of the country's biggest markets even though traditional sports wagering remains prohibited in the state. The prediction market platform lets users trade event contracts tied to sports, politics, entertainment, and other real-world outcomes. For DraftKings, California represents something its traditional sportsbook business has not been able to get: a way into the state.
The launch also puts DraftKings in more direct competition with Kalshi and Polymarket, which already offer prediction markets to California users. That makes this about more than simply adding another state to the map. California could become one of the most interesting tests yet of how event contracts fit alongside state laws written long before prediction markets reached their current scale.
California Opens a Very Different Door for DraftKings
California voters rejected two sports wagering measures in 2022. Proposition 26 would have allowed sports wagering on tribal lands, while Proposition 27 sought to legalize online and mobile wagering outside those lands. Neither received enough support from voters.
Prediction markets operate through a different framework. Event contracts offered through federally regulated exchanges fall under Commodity Futures Trading Commission oversight, creating a path into states where traditional sportsbooks cannot currently operate. DraftKings Predictions is using that structure to offer California users markets covering everything from sports results to the year's top Spotify song and future elections.
That difference creates a pretty unusual situation. Californians still cannot open the traditional DraftKings Sportsbook, but eligible users can access DraftKings Predictions and trade sports-related event contracts. The products can look similar from a user's perspective, but their structure and regulatory treatment are different.
Why California is Such a Big Prize
Prediction market companies want California for one simple reason: size. James Siva, chairman of the California Nations Indian Gaming Association, described the state as the "golden goose" because of how important its population could be to gaming companies. DraftKings now gets an opportunity to build a California customer base without waiting for another statewide legalization campaign.
A few factors make the launch particularly interesting:
- California is the most populous state in the country.
- DraftKings already has substantial national brand recognition.
- Kalshi and Polymarket are competing for many of the same prediction market users.
- Traditional DraftKings Sportsbook remains unavailable in California.
- California tribal groups have raised concerns about prediction markets entering the state.
DraftKings could also have an advantage that prediction-market-first companies do not. Millions of sports fans already know the DraftKings name, so introducing those users to a new product may be easier than building recognition from scratch.
The Next Fight Could Be Regulatory
The bigger question is what California does next. Prediction markets have created tension between federal oversight of event contracts and states that argue certain sports-related products fall under their own gaming laws. DraftKings entering the picture gives California policymakers another major company to consider.
Tribal interests could become especially important. Siva has already expressed concern that prediction markets could pull activity away from tribal gaming operations that support jobs and community funding. California's previous fights over sports wagering were expensive and politically complicated, so the arrival of event contracts adds another layer to an already crowded legal debate.
The Trade Handle Prediction Markets Take
We think California shows exactly why prediction markets have become so strategically important to companies like DraftKings. This is no longer simply about launching another trading product. Prediction markets can potentially give established operators access to customers in places where their traditional sportsbook products cannot go.
California could now become a major battleground between DraftKings, Kalshi, Polymarket, tribal interests, state officials, and federal regulators. DraftKings has found a path into a market it has wanted for years, but getting through the door may be easier than figuring out how long that door stays open.
